Anmälningsplikt vid köp av byggtjänster : Case: Bostadsaktiebolag X

Abstract

Det här lärdomsprovet handlar om anmälningsplikten vid köp av byggtjänster som trädde i kraft 1.7.2014. Under vissa förutsättningar måste den som beställer byggtjänster göra månatliga anmälningar om entreprenader och arbetstagare till Skatteförvaltningen. Bestämmelsen är avsedd att försöka stävja den grå ekonomin inom byggbranschen. Syftet med mitt arbete är att samla information om anmälningsplikten för styrelsemedlemmar och disponenter i bostadsbolag. I teoridelen förklarar jag centrala begrepp som byggtjänst, beställare, huvudsaklig genomförare och gemensam byggarbetsplats. Jag tar upp olika webbtjänster som finns tillgängliga för bygganmälningar och ger en överblick over anmälningsprocessen. I slutet av teoridelen beskriver jag steg för steg hur elektroniska entreprenad- och arbetstagaranmälningar görs i Suomi.fi-tjänsten. Den empiriska undersökningen utförs i form av en kvalitativ fallstudie av Bostadsaktiebolag X, där jag samlat information från bostadsbolagets protokoll om renoveringsbeslutsprocessen och entreprenader som godkänts. Jag redogör för hur bolagets bygganmälningar ska göras. Därefter analyserar jag både besluts- och anmälningsprocessen. Nyckeln till smidiga, korrekta och effektiva anmälnings-processer ligger i att utse den person/de personer som ska ansvara för anmälningarna, i ett relativt tidigt skede av beslutsprocessen om renoveringar.

In this thesis I discuss the duty to report purchase of construction services. The duty to report started on 1 June 2014. Under certain circumstances the orderer of the construction service has to give details on contracts and the employees working on the construction site on a monthly basis to the Finnish Tax Administration. The purpose of the regulation is to fight underground economy in the construction business. The aim of the thesis is to collect information for members of the board and manager in housing companies. In the theory part I describe essential words like construction service, orderer, the main implementer and common construction site. I present different web services that can be used when reporting the construction services and give an overall view over the reporting process. The theory part ends with instructions for how the reporting of contracts and employees should be made step by step using the Suomi.fi web service. The empiric part is a qualitative case study of housing company X. The information is based on the housing company’s minutes concerning the decisions on the renovations and the contracts that have been accepted by the board. I present how the construction services should be reported. Then I analyse both the decision process and the reporting process. The key to smooth, correct and effective reporting is to choose the right person(s) being in charge of submitting the reports, in a relatively early stage of the decision-making process concerning the renovations.
